1. Who we are
1.1 PhotoSketch AI is operated by COLEAI LIMITED, a company registered in England and Wales (company number 17125345) with its registered office at 325-327 Oldfield Lane North, Greenford, Middlesex, UB6 0FX, United Kingdom ("we", "us", "our").

2. These terms
2.1 These terms apply when you use PhotoSketch AI, whether you use the free preview or make a purchase. By uploading a photo or buying a page, you agree to them.
2.2 These terms cover digital downloads only. Any physical products shown on the site as "coming soon" (such as a printed colouring book) are not currently for sale and are not covered by these terms.
2.3 Nothing in these terms affects your statutory rights as a consumer, including your rights under the Consumer Rights Act 2015 that digital content must be as described, of satisfactory quality and fit for purpose.
3. What the service is
3.1 You upload a photograph (JPG, PNG or WebP, up to 15 MB) and PhotoSketch AI generates one black-and-white colouring-page version of it, using artificial intelligence. You can upload more than one photograph, and each one produces its own page.
3.2 Because the pages are generated by AI, the results vary with the photo you provide. That is why we show you a free watermarked preview first: the preview you see is the exact page you will receive, minus the watermark. Please check the preview before buying.
3.3 We do not promise that a generated page will meet any particular artistic expectation beyond what the preview shows.
4. Free previews and your account
4.1 Watermarked previews are free, and to keep the service viable they are limited per day. If you are not signed in, the allowance is counted per device or network (IP address). If you are signed in, it is counted per account, and the allowance is larger. If you reach the limit, you can return the next day.
4.2 We may change or withdraw the free preview tier at any time. This does not affect purchases you have already made.
4.3 Watermarked previews are for evaluation only. You may not remove or attempt to remove watermarks, and you may not use watermarked previews for any purpose other than deciding whether to buy.
4.4 You can use the free preview without an account. To go further you create an account by giving us your email address: we email you a sign-in link, and following it signs you in. There is no password. Your account holds your email address, your credit balance and a record of the pages you have made, so you can come back to them. How we handle that data is set out in our Privacy Policy.
4.5 Anyone who can read your email can sign in to your account, because that is how a sign-in link works. Keep your sign-in links to yourself, do not forward them, and sign out on a device you share. Tell us at support@photosketchai.com if you think someone else has been in your account.
4.6 You must be at least 18 to create an account. You can ask us to close and delete your account at any time by emailing support@photosketchai.com; what we delete and what we must keep is explained in our Privacy Policy. We may suspend or close an account that is being used to abuse the service (see clause 9.2), and we will refund any credits you have paid for and not used if we do so.
5. Purchases and prices
5.1 We sell one-off digital downloads. One page means one clean (watermark-free), print-ready page generated from one photograph:
(a) £2.99 for one page; (b) £7.99 for three pages (£2.66 each); or (c) £14.99 for ten pages (£1.50 each).
You can buy up to ten pages in a single order. We always charge you the cheapest combination for the number of pages you are buying, so adding another page can never increase your price per page.
5.2 Prices are in pounds sterling and include any applicable VAT.
5.3 Payment is taken by our payment provider, Stripe, at checkout. We never see or store your card details.
5.4 We sell in two ways: one-off purchases, described in this clause 5, and a monthly subscription, described in clause 6. A one-off purchase is a single transaction and nothing recurs. A subscription renews automatically each month until you cancel it. You are never put on a subscription by making a one-off purchase.
5.5 You must be at least 18 years old to make a purchase.
5.6 If you are signed in when you buy, what you have paid for is added to your account as credits. One credit unlocks one page: spending it removes the watermark from that page and gives you the print-ready file. A credit is spent once per page, so opening the same page again never costs you a second credit.
5.7 Credits have no cash value and cannot be transferred or exchanged for money, except where we refund them under clause 4.6, clause 5.8 or our Refund Policy. They do not expire while your account is open.
5.8 If you ask us to delete your account and you still hold credits you have paid for, tell us at support@photosketchai.com and we will refund the unspent credits you paid for before we close the account. We will not refund credits we gave you free, such as the credit that comes with a new account, because you did not pay for those.
6. Subscriptions
6.1 What it costs and what you get. Our subscription is £19.99 per month, and it gives you 20 credits each month. Credits work exactly as described in clause 5.6.
6.2 It renews automatically. This is a rolling monthly contract with no minimum term. Unless you cancel, it renews automatically every month on the same date, and we charge your card automatically each time, for as long as it continues. We will tell you by email each time we take a payment.
6.3 Unused credits roll over, up to a limit. Credits you do not spend stay in your account and are added to the next month's, up to a maximum balance of 40 credits. Once you are holding 40 credits, a further monthly payment adds no more until you spend some. If you are near the cap, consider cancelling and resubscribing later rather than paying for credits you cannot receive.
6.4 Cancelling. You can cancel at any time from your account, or by emailing support@photosketchai.com. Cancellation takes effect at the end of the month you have already paid for, not immediately: you keep the service, and any credits already in your account, until that date. We do not take a further payment after you cancel.
6.5 What happens to your credits when you cancel. Credits already in your account stay yours and remain usable while your account is open. We do not take them back when you cancel.
6.6 What happens to your credits and your subscription if you delete your account. Deleting your account ends your subscription, and we will refund any unspent credits you paid for under clause 5.8. If you hold a live subscription, please cancel it under clause 6.4 before asking us to delete your account, and contact us at support@photosketchai.com so we can confirm both have been done.
6.7 If a payment fails. If your card is declined, your subscription does not end straight away: our payment provider retries it, and we keep your service running while it does. If payment ultimately fails, your subscription ends and any credits already in your account stay yours.
6.8 Changing the price. If we change the subscription price, we will tell you by email at least 30 days beforehand, and you can cancel before the new price applies. A price change never affects a month you have already paid for.
7. Delivery and your cancellation rights
7.1 Delivery is immediate: your purchased file is available to download on the page shown after payment. If you are signed in, it also stays reachable from your account. Download it promptly either way: generated files are automatically deleted 30 days after creation and cannot be recovered after that, and neither we nor your account can bring them back (see our Privacy Policy).
7.2 Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you normally have a 14-day right to cancel an online purchase, starting on the day the contract is made.
7.3 Pages you have already downloaded. For digital content supplied immediately, that right is lost once supply begins, where you have expressly consented to immediate supply and acknowledged losing the cancellation right. By completing checkout you expressly consent to us supplying your file immediately, and you acknowledge that you lose your 14-day right to cancel once the file is supplied. You will have seen the exact watermarked preview of your page before paying.
7.4 If we fail to deliver your file, or the file is faulty, our Refund Policy applies and your statutory rights are unaffected.
7.5 Credits you have not spent. Clause 7.3 applies to a page we have actually supplied to you. It does not apply to a credit you have bought and not yet spent, because at that point we have supplied you nothing. If you cancel within 14 days of buying credits, we will refund every credit you have not spent. Credits you have already spent to unlock a page are not refundable, because that page was supplied to you.
7.6 Cancelling a subscription within 14 days. You may cancel a new subscription within 14 days of taking it out. If you have spent none of that month's credits, we will refund the payment in full. If you have spent some, we will refund the part representing the credits you have not spent. To cancel under this clause, email support@photosketchai.com or use the model cancellation form below. This right applies to a new subscription, not to each automatic monthly renewal of a continuing one.
7.7 How to cancel. Tell us clearly that you are cancelling, by email to support@photosketchai.com or by post to the address in clause 1.1. You may use the form below, but you do not have to.
7.8 Model cancellation form. To COLEAI LIMITED, 325-327 Oldfield Lane North, Greenford, Middlesex, UB6 0FX, United Kingdom, support@photosketchai.com: I hereby give notice that I cancel my contract for the supply of the following digital content / service [describe]. Ordered on [date]. Name of consumer. Address of consumer. Date.
7.9 We will make any refund due under this clause 7 within 14 days of you telling us you are cancelling, using the same payment method you used.
8. Your photo and your responsibilities
8.1 You keep all rights you have in the photo you upload. You grant us a limited licence to process it solely to provide the service to you, as described in our Privacy Policy.
8.2 By uploading a photo you confirm that:
(a) you own the photo or have the right to use it, including any permission needed from the photographer; (b) you have the permission of any identifiable person shown in it (for a child, the permission of their parent or guardian); (c) the photo is not unlawful, and does not contain content that is obscene, abusive, or that infringes anyone's rights.
8.3 You are responsible for what you upload. If your upload breaks these rules, you are responsible for any resulting claims against us to the extent the law allows.
9. Moderation
9.1 Uploads pass through automated moderation. We may decline to process an image that appears to break clause 8 or our AI provider's usage policies. A declined image at the preview stage costs you nothing.
9.2 We may suspend or block access for attempts to abuse the service, including attempts to bypass rate limits, remove watermarks, or upload unlawful content.
10. Your licence to use purchased pages
10.1 When you buy a page, we grant you a personal, non-exclusive, non-transferable licence to download, print and use it for personal, non-commercial purposes. Print as many copies as you like for yourself, your family and your friends.
10.2 You may not sell, licence, distribute or otherwise commercialise purchased pages, use them in products or services offered to others, or present them as your own or anyone else's original artwork for commercial gain.

11. Our intellectual property
11.1 We (and our licensors) own the PhotoSketch AI service, site, branding and the technology behind it. Nothing in these terms transfers any of that to you.
11.2 You may not copy, scrape, reverse engineer or build a competing service from PhotoSketch AI.
12. Our responsibility to you
12.1 Nothing in these terms excludes or limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any other liability that cannot be excluded or limited under the law of England and Wales, including your statutory rights under the Consumer Rights Act 2015 (for example, if our digital content damages your device or other digital content because we failed to use reasonable care and skill).
12.2 Subject to clause 12.1, if we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or our failure to use reasonable care and skill, and our total liability to you in respect of any purchase is limited to the price you paid for that purchase.
12.3 The service is for private, personal use. Subject to clause 12.1, we are not liable for business losses, and we are not liable for losses that were not foreseeable to both of us when the contract was made.
12.4 Remember that files are deleted after 30 days. Subject to clause 12.1, we are not responsible for loss of a file you did not download within that period, though if this happens to you, contact us and we will try to help.
13. Availability and changes
13.1 We aim to keep the service available but do not guarantee uninterrupted access. We may suspend, withdraw or change the service. This does not affect completed purchases: if you have paid and not received your file, our Refund Policy applies.
13.2 We may update these terms from time to time. The version on this page at the time of your purchase is the one that applies to that purchase. If you hold a subscription and we make a change that affects it, we will tell you by email at least 30 days beforehand and you can cancel before it takes effect.
14. General
14.1 If any part of these terms is found to be unenforceable, the rest remains in force.
14.2 If we delay enforcing any part of these terms, we can still enforce it later.
14.3 This contract is between you and COLEAI LIMITED. No one else has rights under it. We may transfer our rights and obligations under these terms to another organisation; we will tell you if this happens, and it will not reduce your rights.
15. Governing law and disputes
15.1 These terms are governed by the law of England and Wales.
15.2 You can bring legal proceedings in the courts of England and Wales. If you live in Scotland you may also bring proceedings in Scotland, and if you live in Northern Ireland you may also bring proceedings in Northern Ireland.
15.3 If you have a problem, please contact us first at support@photosketchai.com. Most issues can be sorted out quickly and without formality.
